This Acceptable Use Policy (“AUP”) governs your use of the services provided by AMG Quality Services and is incorporated by reference into the company’s Terms of Service. Unless otherwise stated, defined terms in this AUP have the same meaning as provided in the Terms of Service. AMG Quality Services may modify this AUP at any time without notice.

The OEMS-Designed to Amaze system and services provided by AMG Quality Services may only be used for lawful purposes. By using these services, you agree to comply with all applicable laws, rules, and regulations. AMG Quality Services reserves the right to refuse service to anyone at its sole discretion. Any material or conduct that, in our judgment, violates this AUP may result in suspension or termination of the services or removal of content, with or without notice.

Failure to respond to a communication from our abuse department within the specified time period may result in the suspension or termination of the services.

Prohibited Uses

You may not directly or indirectly use the OEMS-Designed to Amaze system or any related services in connection with any of the following, as determined in AMG Quality Services‘ sole discretion:

  • Publishing content or engaging in activity that is illegal under applicable law, harmful to others, or that would subject AMG Quality Services to liability, including, without limitation:
    • Disclosing sensitive personal information about others.
    • Storing personal or sensitive information, including “Protected Health Information” under HIPAA.
    • Engaging in phishing or identity theft.
    • Distributing viruses, worms, or other malicious code.
    • Promoting or facilitating prostitution, human trafficking, or sex trafficking.
    • Hosting ponzi or pyramid schemes or deceptive marketing practices.
    • Hosting or distributing child sexual abuse material (CSAM) or any content harmful to minors.
    • Engaging in unlawful distribution of controlled substances, drug contraband, or prescription medications.
    • Facilitating gambling.
    • Promoting violence or terrorism.
    • Infringing on the intellectual property or proprietary rights of others.

Excessive Use of Resources or Network Abuse

You may not consume excessive amounts of system resources or use the services in a manner that impacts server performance or interrupts service for other customers. Prohibited activities include, without limitation:

  • Hosting or linking to an anonymous proxy server.
  • Operating file sharing sites.
  • Hosting scripts or processes that adversely affect system performance.
  • Utilizing software that interfaces with an Internet Relay Chat (IRC) network.

Unauthorized System Access

You may not use the services to gain unauthorized access to any network or system, including without limitation:

  • Accessing another network or system without permission, probing for vulnerabilities, or breaching security measures.
  • Launching attacks such as Denial of Service (DoS) attacks.
  • Intercepting or monitoring data without permission.
  • Using bots, crawlers, spiders, or other automated devices to access, copy, or index any portion of AMG Quality Services’ websites or servers for unauthorized purposes.

Storage of Backups

You may not use your account or the OEMS-Designed to Amaze system as a backup solution. The services provided are for hosting purposes only and may not be used as a data repository. AMG Quality Services reserves the right to remove backups without notice.

Zero Tolerance Spam Policy

Any account that causes our IP space to be blacklisted will be immediately suspended or terminated. The following activities are prohibited:

  • Forging or misrepresenting message headers.
  • Hosting websites advertised via spam (i.e., “Spamvertised”).
  • Selling contact lists or sending bulk unsolicited messages.
  • Sending spam or unsolicited emails.

Enforcement

Violation of this AUP may result in the suspension or termination of your services, with or without notice. AMG Quality Services reserves the right to disable or remove any content deemed harmful, prohibited, or in violation of this AUP.

Violations may be reported to law enforcement at the discretion of AMG Quality Services. Failure to respond to communication from our abuse team within forty-eight (48) hours may result in account suspension or termination.
